Competition legal notice

Organizer:
Motorrad Meyer GmbH & Co. KG, Grüner Weg 123, 52070 Aachen, hereinafter “organizer”, is the organizer of the above.a competition. The competition will be published via the Instagram channel @myclturell. The competition runs for 5 days from the time of the post on the above-mentioned profile, until the 14th.11.2022 at 11:59 p.m.
Competition process:
Only natural persons who are resident in the EU can take part in the competition. Participation takes place exclusively online. By participating in the competition, all participants agree to these terms and conditions.
Participation in the competition takes place by clicking the corresponding three marks under the above.G Post and sharing the competition post in your own Instagram story. In addition, the channels @myclturell and @motorrad.meyer for participation.The winners will be determined after the closing date for participation in a random raffle among all participants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the raffle.
The winners will be drawn by lottery within 24 hours after the end of the competition period and will be contacted immediately by a message on their Instagram profile from @myclturell. 1 winner will be chosen for each prize. There is a total of 1 winner. If the respective winner does not respond after 48 hours of being notified of the win, the claim to the prize will no longer be valid.
Participation is only permitted once per person/user and per post.
The following prizes will be drawn among the participants:
1x “Easy Kangaroorider yellow” motorcycle gloves worth €79.95. A payout of the winnings is not possible.
Organizers are not responsible for the accuracy of the information. If a delivery attempt fails, organizers are not obliged to attempt delivery again.
Organizers are not responsible for the accuracy of the information. All prizes will be sent to the respective winners. It is not possible to collect the prize at another location.Any subsequent costs such as customs duties or shipping to another location or abroad must be borne by the winner.
Competition Exclusions:
Participation in the competition is only permitted if all personal information is correct. Organizers are entitled to exclude individuals from participation if there are legitimate reasons, such as:b a violation of the terms and conditions, manipulation, etc. present. Participation on behalf of someone else, especially through competition agencies, is not permitted. Winnings cannot be transferred to third parties.
Data protection:
In order to take part in the competition, you must provide personal data. The personal data collected will be collected, stored and used for the purpose of conducting the competition. All of the participants’ personal data will neither be passed on to third parties nor made available for their use without their consent. In this context, organizers are entitled to transmit the winners' data to cooperation partners in order to enable the prizes to be delivered. The winners’ names can be published on the organizer’s website and/or social media channels. Winners expressly agree to this form of publication.
The participants can revoke their declared consent at any time. The revocation must be sent to the organizer in writing or by email. After consent is revoked, the participants' personal data collected and stored will be deleted immediately.
Personal data will not be transferred to third parties for purposes other than those listed below.
We only pass on your personal data to third parties if:
– you provide your personal data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO have given express consent,
- the transfer in accordance with Art. 6 para. 1 p. 1 lit. f GDPR is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,
- In the event that the disclosure is required in accordance with Art. 6 para. 1 p. 1 lit. c GDPR there is a legal obligation and this is legally permissible and in accordance with Art. 6 para. 1 p. 1 lit. b GDPR is required for the processing of contractual relationships with you.
Changes to the conditions of participation and termination of the competition:
Organizers can end the competition at any time if this becomes necessary due to adverse circumstances that the organizers cannot otherwise avert.
Furthermore, organizers can change or suspend the competition at any time for the same reasons if this is the only way to ensure proper overall implementation of the competition.
If such a modification/termination is caused by the behavior of participants, influencers are entitled to demand compensation for the damage caused from these people.
Limitations of liability:
All information is provided without guarantee. Organizers assume no liability unless there is intent or gross negligence. However, mandatory liability rules (particularly according to food law regulations) are excluded from the above limitation of liability.
The organizer assumes no liability for data loss, particularly through data transmission, and other technical defects beyond the organizer's control.
Other
Competitions can be organized by the organizer in cooperation with various partners (in this case the cooperation partner is the customer), who may who provide the prizes (prize sponsor). Organizers represent the cooperation partners during the implementation of the competition and promise to give the prizes donated by them solely in their name. This does not oblige organizers to provide their own services, unless the organizers themselves are sponsors of the prize in the specific case.
The exclusively applicable law is the law of the Federal Republic of Germany. If any of these conditions are or become ineffective, the validity of the remaining conditions of participation remains unaffected. One possibly Ineffective clause will be replaced by an economically comparable regulation.
Legal recourse is excluded.
We reserve the right to exclude participants from the competition for important reasons and to reclaim prizes, especially if there is reasonable suspicion or evidence of false information, manipulation, violation of these conditions of participation or other unlawful acts.
